Terms of Service

1. The Service

IT-Stuff Attendance ("the Service"), available at attendance.it-stuff.in, is a subscription-based attendance management platform operated by IT-Stuff, India ("we", "us"). It lets a registered organization ("Entity") record attendance of its employees/members using GPS geo-fencing, QR codes and photo check-in.

2. Accounts

• You must provide accurate organization details at signup and keep your login credentials confidential.
• Everything done through your account is your responsibility. Notify us immediately of any unauthorized use.
• You confirm you have the authority (and any consent required) to enroll your employees/members and process their attendance data.

3. Subscription, Trial & Payments

• New Entities receive a free trial. After the trial, continued use requires a paid plan (Basic, Pro or MAX), billed in advance via Cashfree Payments.
• Each plan has an employee limit; locations are unlimited on all plans.
• When a subscription expires, attendance marking is paused; your data and admin access remain available so you can renew.
• Prices may change; changes never affect a period you have already paid for.
• Refunds are governed by our Refund Policy.

4. Acceptable Use

• No unlawful use, no attempt to breach security, probe other Entities' data, or overload the Service.
• No reselling, sublicensing or white-labelling the Service without our written agreement.
• We may suspend accounts that violate these terms or remain unpaid.

5. Intellectual Property

The Service — including its software, design, workflows and documentation — is the exclusive property of IT-Stuff and is protected by copyright law. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for your own organization's attendance management, and nothing more. Copying, decompiling, or creating derivative works of the Service is prohibited. Your data remains yours (see Section 6).

6. Your Data

All attendance records, employee details and files you upload belong to your Entity. We process them only to provide the Service, as described in the Privacy Policy. You can export your data (CSV/print) at any time from the admin panel.

7. Availability & Liability

We aim for high availability but the Service is provided "as is" without warranties of uninterrupted or error-free operation. GPS accuracy depends on the user's device and environment. To the maximum extent permitted by law, our total liability for any claim is limited to the subscription fees you paid in the three months preceding the claim. We are not liable for indirect or consequential losses, including HR or payroll decisions made using attendance data.

8. Termination

You may stop using the Service at any time. We may terminate accounts for breach of these terms with notice where practicable. On termination you may request a final export of your data within 30 days, after which it may be deleted.

9. Governing Law

These terms are governed by the laws of India. Courts at Lucknow, Uttar Pradesh have exclusive jurisdiction.
